1-Definitions
Carrier means London Fashion Logistics Ltd.
Client means the person who contracts for the services of the Carrier.
Conditions means the conditions of carriage, which shall apply to the contract of
the carriage between the Client and the Carrier.
Recipient means the person to whom the Carrier delivers the Samples.
Samples are the goods to be considered for media articles with regard to fashion or
homewares, and fashion show invitations.
Excluded goods are anything of high value or deemed breakable.
2-Delivery
2.1 The Client shall ensure that the Samples are secure, properly packed and
labelled and is fit to be transported by road.
2.2 The Carrier will use all reasonable efforts to deliver within the time specified
for the delivery taking into account any major travel disruptions due to events or
other unforeseen circumstances.
2.3 Where Samples cannot be delivered (for whatever reason) or is held by the
Carrier to await further instruction and this is not forthcoming the Samples will be
returned to the Client. If this is not possible (in the case of returns clients where
address or Recipient cannot be found) Samples will be kept for a reasonable time
of one calendar month.
2.4 The Recipient is deemed responsible for the Samples on signing receipt of the
Samples.
2.5 Where proof of delivery is requested this should happen within a reasonable
time of 14 days.
2.6 The working week is Monday to Friday excluding public holidays.
3-Carrier's charges
3.1 Payment terms are 30 days from date on invoice, any variation on this must be
made in writing, with at least 5 working days notice.
3.2 All prices quoted are exclusive of VAT and waiting time is limited to 15 minutes
either for collection or delivery.
3.3 The Carrier shall be entitled to recover any expenses incurred in attempting to
make a delivery.
3.4 There will be further charges made if the delivery is attempted more than
once.
3.5 If there has been no agreement sought for large collections the client will be
advised of an extra charge befitting the volume.
4-Limitation of liability
4.1 Notification must be given if the Samples given to the Carrier exceed £1,000 in
value to £5,000. Any items above this in value should not be included in the
Samples delivery as we cannot be held responsible for damage incurred or high
value losses. All items are at cost of replacement only.
4.2 In the event of an act of God, outbreak of hostilities, riot, civil disturbance,
acts of terrorism, fire, explosion or flood, failure of telecommunication lines, fuel
shortage, any strike or any other form of industrial action the Carrier shall not be
liable for any loss, mis-delivery or damage as a result.
4.3 Insufficient or improper packing, labelling or addressing.
4.4 Claims for loss or damage must be made within 24 hours of the Samples being
delivered or will not be accepted.
4.5 The carrier shall not in any circumstances be liable for any loss or damage
where there has been fraud on the part of the client, owner of the Samples, unless
the fraud has been committed by the Carrier or its employees acting in the course
of their employment.
4.6 The Client shall provide written proof of the cost value (not retail) of the
Samples damaged or lost and the Carrier shall be entitled to inspect the damaged
Samples.
4.7 The Carrier shall not in any circumstances be liable for loss or damage after
delivery has been received and signed for.
4.8 Act, omission or misrepresentation by the client, owner of the Samples.
4.9 Seizure or forfeiture under legal process.
5-Excluded goods
These are, without limitation: jewellery, precious stones, precious metal, watches,
glass, furs, china, art, antiques, fragile and perishable goods, money and any other
items that are (at its sole discretion) considered valuable by the carrier. Any of
these items must be discussed and agreed with the carrier before collection and
cannot be covered by any insurance of the carrier.
6- Cancellation
In the event of a cancellation of Samples collection from another address other
than the Client’s that results in a delay in the Carrier’s workload there will be a
charge.
